What is CBD?

CBD - also known as cannabidiol - is a compound found in the cannabis plant (as well as naturally produced in our bodies).

CBD UK Laws 2022

However, recent legislation altered the Misuse of Drugs Act 1971 and exempted CBD and other related cannabinoids as class B drugs. Therefore, CBD is completely legal in the country so long as it is derived from an EU-approved help strain.

One red line that remains is the THC content. THC is still considered an illegal recreational drug and any CBD product containing more than 0.3% THC is considered illegal.

Here are some laws that have been applicable for the CBD market;

  • CBD products are classed as food supplements when ingested or a cosmetic when used topically.
  • The maximum legal limit for THC in the UK is 1mg per container for safe use.
  • CBD product manufacturers should refrain from making any medical claims.
  • The users can buy CBD products legally; however, it remains illegal to grow their own help plants for personal use.
  • The sale of CBD buds and flowers is illegal. They also cannot be used in food and CBD products.

MHRA and CBD

The Medicines and Healthcare products Regulatory Agency has given various statements [4] to the public addressing CBD use.

In 2016, the agency stated;

“Our primary concern is patient safety and we wish to reiterate that individuals using cannabidiol (CBD) products to treat or manage the symptoms of medical conditions should discuss their treatment with their doctor.

MHRA will now work with individual companies and trade bodies in relation to making sure products containing CBD, used for a medical purpose, which can be classified as medicines, satisfy the legal requirements of the Human Medicines Regulations 2012.”

As the market is expanding, we can expect the MHRA and the government to release more such statements and regulations to ensure a safe and legal market for CBD products that works in favour of both users and trusted manufacturers.
